Please read them carefully before using the website or placing an order.

2. Eligibility to Use the Website

You must have the legal capacity to enter into a binding transaction in order to make purchases through Subhavi.lk.

If you are not legally able to enter into such a transaction independently, you should use the website and make purchases only with the involvement and permission of a parent or legal guardian.

By placing an order, you confirm that the information you provide is accurate and that you are authorized to use the selected payment method.

3. Use of the Website

When using Subhavi.lk, you agree:

  • To provide accurate, complete, and current information;
  • Not to use the website for unlawful, fraudulent, or unauthorized purposes;
  • Not to interfere with the operation or security of the website;
  • Not to attempt to gain unauthorized access to any part of the website, server, account, or system;
  • Not to introduce viruses, malicious software, or other harmful material;
  • Not to impersonate another person or provide false information; and
  • Not to use the website in a manner that may damage Subhavi Publishers, its customers, or third parties.

We reserve the right to restrict or suspend access to the website where we reasonably believe it is being misused.

4. Customer Accounts

Certain features of Subhavi.lk may allow customers to create an account.

If you create an account, you are responsible for:

  • Maintaining the confidentiality of your login details;
  • Providing accurate account information;
  • Keeping your information reasonably up to date; and
  • Informing us if you suspect unauthorized access to your account.

You are responsible for activities carried out through your account unless the activity occurred because of circumstances for which you are not reasonably responsible.

5. Product Information

Subhavi Publishers makes reasonable efforts to provide accurate information about products displayed on Subhavi.lk, including information such as:

  • Book title;
  • Author;
  • Translator, where applicable;
  • Publisher;
  • Price;
  • Cover image;
  • Description;
  • ISBN, where applicable; and
  • Other relevant product information.

However, minor differences may occur between product images displayed online and the physical product received.

Colours may also appear slightly different depending on the customer’s screen, device, display settings, printing variation, or edition.

Product images are generally provided for identification and presentation purposes.

6. Product Availability

All products displayed on Subhavi.lk are subject to availability.

Adding an item to your shopping cart does not guarantee that the item will remain available until the order is successfully completed.

In rare circumstances, a product may become unavailable after an order has been placed.

If we are unable to supply an ordered product, we will contact you and may offer:

  • A suitable alternative;
  • Delivery when the product becomes available; or
  • A refund for the unavailable item.

You are not required to accept an alternative product.

7. Prices

Product prices will be displayed on Subhavi.lk.

Unless otherwise stated, prices displayed on the website are in Sri Lankan Rupees (LKR).

Applicable delivery, courier, or other charges will normally be displayed or communicated before the order is completed, where applicable.

Prices may change from time to time without prior notice.

However, a price change will not normally affect an order that has already been successfully placed and confirmed, except where there is an obvious pricing or technical error.

8. Pricing and Website Errors

We make reasonable efforts to ensure that prices and product information are accurate.

However, typographical, technical, or administrative errors may occasionally occur.

If a product has been listed with an obviously incorrect price or materially incorrect information, we may contact you before fulfilling the order.

Where appropriate, you may be given the option to:

  • Proceed with the order at the correct price;
  • Select an alternative product; or
  • Cancel the affected item or order and receive an applicable refund.

We will not intentionally charge a customer an additional amount without informing the customer.

9. Placing an Order

By submitting an order through Subhavi.lk, you are requesting to purchase the products listed in your order.

You are responsible for reviewing the following information before completing your order:

  • Products selected;
  • Quantities;
  • Prices;
  • Customer name;
  • Telephone number;
  • Email address;
  • Delivery address; and
  • Payment information or payment method.

After an order is submitted, you may receive an electronic order acknowledgement or confirmation.

We reserve the right to reject or cancel an order where reasonably necessary, including where:

  • The product is unavailable;
  • Payment cannot be verified;
  • The order contains an obvious pricing or technical error;
  • Delivery information is incomplete or invalid;
  • We reasonably suspect fraud or unauthorized activity; or
  • We are unable to fulfil the order for another legitimate reason.

If we cancel an order after receiving a successful payment, an appropriate refund will be arranged in accordance with our Refund, Return & Cancellation Policy.

10. Payments

Customers must pay the total amount applicable to their order, including the product price and any applicable delivery or other charges displayed during checkout.

Subhavi.lk may accept online payments through PayHere and other payment methods displayed on the website from time to time.

By choosing an online payment method, you confirm that:

  • You are authorized to use the selected payment method;
  • The payment information provided is accurate; and
  • You authorize the applicable payment provider to process the payment required for your order.

Online payment processing may be provided by third-party payment service providers.

Payment transactions may therefore also be subject to the relevant payment provider’s terms, conditions, security procedures, and privacy practices.

11. PayHere Payments

Subhavi.lk may use PayHere as a payment gateway for online transactions.

When a payment is made using PayHere, payment information necessary to complete the transaction may be processed through PayHere’s systems and participating financial service providers.

Subhavi Publishers may receive transaction-related information required to:

  • Confirm payment;
  • Process the customer’s order;
  • Maintain transaction records;
  • Handle cancellations;
  • Process eligible refunds; and
  • Respond to payment-related inquiries.

A successful payment does not override these Terms and Conditions, including provisions relating to product availability, fraud prevention, order errors, returns, or cancellations.

12. Order Confirmation

An order should not be considered successfully completed solely because a payment attempt has been initiated.

Where applicable, fulfilment will proceed after we have received appropriate confirmation of the order and payment status.

If you believe that money has been deducted but you have not received an order confirmation, please contact us with the relevant payment and order information so that we can investigate the transaction.

13. Shipping and Delivery

Subhavi Publishers will make reasonable efforts to dispatch and deliver orders within the expected delivery period.

Delivery times provided through Subhavi.lk or communicated to customers are estimates unless specifically stated otherwise.

Delivery times may vary depending on factors including:

  • Customer location;
  • Courier availability;
  • Public holidays;
  • Weather;
  • Operational delays;
  • Incorrect or incomplete delivery details; and
  • Other circumstances outside our reasonable control.

A delay in delivery does not automatically entitle a customer to compensation, except where required by applicable law or agreed by Subhavi Publishers.

14. Customer Delivery Information

Customers are responsible for providing accurate and complete delivery information.

This includes:

  • Recipient name;
  • Delivery address;
  • Telephone number; and
  • Any other information reasonably required for successful delivery.

Subhavi Publishers will not be responsible for delays or failed deliveries caused by inaccurate or incomplete information supplied by the customer, except to the extent that the problem resulted from an error on our part.

Additional courier or re-delivery charges may apply where a parcel must be resent because of incorrect customer-provided information, inability to contact the recipient, or refusal to accept delivery.

15. Inspection of Orders

Customers are encouraged to inspect their order after delivery.

If you receive a product that is:

  • Incorrect;
  • Damaged;
  • Defective;
  • Missing from the order; or
  • Supplied in an incorrect quantity,

please contact us as soon as reasonably possible in accordance with our Refund, Return & Cancellation Policy.

We may request photographs or other reasonable information to verify the issue.

16. Cancellations, Returns, Exchanges and Refunds

Cancellations, returns, exchanges, and refunds are governed by the Refund, Return & Cancellation Policy published on Subhavi.lk.

Customers should review that policy before placing an order.

In general, eligibility may depend on matters such as:

  • Whether an order has already been dispatched;
  • When the customer contacts us;
  • The condition of the returned product;
  • Whether an incorrect or defective product was supplied; and
  • Product availability.

Nothing in these Terms is intended to remove any mandatory rights available to customers under applicable law.

17. Promotions and Discounts

From time to time, Subhavi Publishers may provide:

  • Discounts;
  • Coupon codes;
  • Promotional offers;
  • Book fair offers;
  • Bundled products;

  • Other promotional campaigns.

Promotions may be subject to specific conditions, including:

  • Start and end dates;
  • Minimum order amounts;
  • Selected products;
  • Limited availability;
  • One-time use restrictions; or
  • Other promotional requirements.

Unless otherwise stated, promotional offers cannot be exchanged for cash.

Subhavi Publishers reserves the right to withdraw or correct a promotion where necessary because of an error, misuse, fraud, or circumstances outside our reasonable control.

Copyright and other intellectual property rights relating to books offered for sale remain with the applicable authors, publishers, illustrators, photographers, translators, designers, or other rights holders, as applicable.

Purchasing a book does not transfer the copyright or intellectual property rights in that book to the purchaser.

You may not reproduce, republish, distribute, commercially exploit, modify, or use protected website content without the permission of the applicable rights holder, except where such use is permitted by law.

19. Prohibited Resale or Reproduction

Purchasing a physical book gives the customer ownership of that physical copy, subject to applicable law.

It does not give the customer permission to:

  • Reproduce the book;
  • Scan and distribute the book;
  • Upload unauthorized digital copies;
  • Reprint copyrighted content;
  • Produce counterfeit copies; or
  • Commercially exploit protected content without authorization.

Any permitted resale of a legitimately purchased physical copy remains subject to applicable law.

20. Website Availability

We aim to keep Subhavi.lk available and functioning properly.

However, access may occasionally be interrupted because of:

  • Website maintenance;
  • Technical problems;
  • Hosting issues;
  • Security updates;
  • Internet service interruptions; or
  • Circumstances outside our reasonable control.

We do not guarantee that the website will always operate without interruption or error.

We may modify, suspend, or discontinue website features where reasonably necessary.

21. Third-Party Services and Links

Subhavi.lk may use or link to third-party services, including:

  • Payment gateways;
  • Courier services;
  • Social media platforms;
  • Analytics providers;
  • Hosting providers; and
  • Other online services.

Third-party websites and services may operate under their own terms and privacy policies.

Subhavi Publishers is not responsible for the content, availability, security, or independent practices of third-party websites outside our reasonable control.

22. Privacy

Your use of Subhavi.lk and the processing of personal information are also governed by our Privacy Policy.

Please review the Privacy Policy to understand how we collect, use, disclose, store, and protect personal information.

23. Security and Fraud Prevention

Subhavi Publishers may take reasonable steps to protect customers and the website against fraud, unauthorized transactions, misuse, and security threats.

We may delay, decline, cancel, or review an order where there are reasonable grounds to suspect:

  • Fraudulent payment;
  • Unauthorized use of a payment method;
  • False customer information;
  • Unusual purchasing activity; or
  • Other security concerns.

Where appropriate, relevant transaction information may be provided to payment providers, financial institutions, or lawful authorities for verification, fraud prevention, dispute resolution, or legal compliance.

24. Limitation of Liability

Subhavi Publishers will make reasonable efforts to ensure that the website, product information, ordering process, and services operate correctly.

However, to the fullest extent permitted by applicable law, Subhavi Publishers will not be responsible for losses arising solely from circumstances outside our reasonable control, including unavoidable third-party service interruptions or courier delays.

Subhavi Publishers will also not be liable for losses resulting from a customer’s misuse of the website, provision of incorrect information, unauthorized sharing of account credentials, or use of products in a manner inconsistent with their intended purpose.

Nothing in these Terms and Conditions is intended to exclude, restrict, or limit any liability or customer right that cannot lawfully be excluded or limited under applicable Sri Lankan law.

25. Indemnity for Misuse of the Website

To the extent permitted by applicable law, you may be responsible for losses reasonably incurred by Subhavi Publishers as a direct result of your unlawful, fraudulent, or unauthorized misuse of Subhavi.lk.

This provision does not apply to ordinary customer use of the website or legitimate consumer complaints.

26. Changes to These Terms

Subhavi Publishers may update these Terms and Conditions from time to time due to:

  • Changes to website functionality;
  • Changes to products or services;
  • Changes to payment or delivery processes;
  • Operational requirements; or
  • Changes to applicable law or regulation.

The revised Terms and Conditions will be published on Subhavi.lk with an updated “Last Updated” date.

Changes will generally apply from the date they are published and will not normally alter completed transactions retrospectively, except where required by law.

27. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

28. No Waiver

If Subhavi Publishers does not immediately enforce a provision of these Terms and Conditions, this does not automatically mean that the provision has been waived.

29. Applicable Law

These Terms and Conditions and transactions conducted through Subhavi.lk are governed by the applicable laws of Sri Lanka.

Any dispute or issue relating to the website or a transaction should first be raised with Subhavi Publishers so that we have an opportunity to address the matter.
